1. General Statement

​

Best Decision Auto Limited is committed to conducting vehicle sales in a fair, transparent, and lawful manner. This Refund Policy complies with the Consumer Guarantees Act 1993 (CGA) and other applicable New Zealand consumer protection legislation.

 

Nothing in this policy limits or excludes any rights a consumer may have under New Zealand law.

2. Consumer Guarantees Act (CGA)

​

Where a vehicle is sold to a consumer (for personal, domestic, or household use), the vehicle must:

 

· Be of acceptable quality

· Be fit for purpose

· Match the description provided

· Be free from undisclosed defects

 

If these guarantees are not met, the customer may be entitled to a remedy under the CGA.

 

 

3. Minor Faults

 

If a fault is considered minor and repairable, Best Decision Auto Limited has the right to:

 

· Repair the fault within a reasonable timeframe, at no cost to the customer

 

Refunds are not automatically provided for minor faults.

 

 

4. Serious Faults

 

A customer may be entitled to a refund or replacement if a fault is considered serious, including but not limited to:

​

· The vehicle is unsafe or substantially unfit for purpose

· The fault cannot be reasonably repaired

· The fault would have prevented the customer from purchasing the vehicle had it been known

 

In such cases, the customer may choose:

​

· A full refund, or

· A replacement vehicle (subject to availability)

 

 

5. Situations Where Refunds Are Not Provided

 

Refunds will not be provided in the following situations:

​

· Change of mind

· Normal wear and tear

· Faults disclosed prior to purchase and acknowledged by the buyer

· Damage or faults caused by misuse, neglect, accidents, or unauthorised repairs after purchase

· Vehicles sold “as is / where is” to trade or business buyers, where the CGA has been contracted out of in writing

 

 

6. Trade & Business Purchases

 

For vehicles purchased for business or trade purposes, the CGA may not apply where:

 

· The vehicle is acquired for commercial use, and

 

· The CGA is expressly excluded in writing at the time of sale

 

In such cases, refunds are not guaranteed and will be governed by the terms of the sale agreement.

7. Deposits

 

· Deposits are generally non-refundable if the purchaser chooses not to proceed with the transaction

· Deposits will be refunded where required by law or if Best Decision Auto Limited is unable to complete the sale

 

 

8. Refund Processing

 

Approved refunds will:

 

· Be made via the original payment method, where possible

· Be processed within a reasonable timeframe

· May be adjusted to account for reasonable vehicle use, where applicable

 

 

9. Requesting a Remedy

 

To request a refund or remedy, customers must:

 

1. Contact Best Decision Auto Limited promptly after identifying an issue

2. Allow reasonable opportunity for vehicle inspection

3. Provide proof of purchase and relevant documentation

 

All matters will be handled fairly, professionally, and promptly.
